Call In
What if Overview and Scrutiny don’t like a decision that has been made or the way it was made?
Where a decision is to be made or has been made by Cabinet or a Portfolio Holder, or where a key decision is to be made by an employee, the decision may be subject to “call-in” by the Overview and Scrutiny Committee.
When a decision has been “called in” the Committee will review it and may request the decision maker(s) to reconsider the decision or (if it has not actually been taken) to take it in a specific way. When the Overview and Scrutiny Committee make such a request, the decision maker(s) must reconsider the decision in the way requested by the Committee. However, they are not required to follow the advice in matters which are the sole responsibility of the decision maker(s) provided they otherwise conform to the rules of the Council and legality.
The Council’s Constitution sets out how a decision may be “called-in” and what happens when a decision is “called in”.
